mobile.de Policy for Dealer Ratings
The ratings published on mobile.de as well as the published dealer-replies exclusively reflect the personal opinion of the respective rater or dealer. mobile.de will check the ratings prior to the publishing only in a limited way in respect of potential violations of this policy. A full review of all content is not effected. mobile.de is therefore not liable for the contents of the ratings.
The ratings are used exclusively in connection with mobile.de. This includes the publishing of the ratings through mobile.de as well as the use for advertising of mobile.de and the ads posted on mobile.de (e.g. by the inclusion into mobile.de advertising banners or other mobile.de advertising material that can be distributed by mobile.de or third parties e.g. on webpages, software applications, in emails or through print, radio and television marketing campaigns). mobile.de is entitled to permit the dealers to use the ratings for the purpose of advertising.
Rules for Ratings
Which Rules apply for Raters?
1. Ratings are based on a personal experience and are unbiased.
a) The rating must be based on a personal service experience with the rated dealer that was initiated through mobile.de. It is not permitted to issue a rating for a third party or by way of technical aids (i.e. robots).
b) There must be no relationship between rater and dealer that could give reason to doubt the objectivity of the rating. For this reason, corporate bodies and employees of a dealer (as well as their relatives in first and second degree) are not permitted to rate the respective dealer.
c) Ratings by dealers or their employees are also not permitted.
d) Ratings for a third party are prohibited. This applies in particular for ratings that are issued on the orders of a dealer or a manufacturer with the aim of gaining positive feedback or to negatively rate another dealer.
e) In order to avoid manipulation, ratings from devices belonging to dealers (e. g. PC, tablets) as well from their internet connections is generally prohibited.
2. Protection of personal data
a) The raters protect their personal data and refrain from disclosing data that is not intended for the public (e.g. name, address or telephone number) as part of the rating text.
b) Identification by name of the staff members of the rated dealer or other persons within the rating text is not permitted. It is also prohibited to include the written conversation with the dealer in the rating.
3. Rating contents must be fair and relevant and must not violate rights of third parties.
a) Ratings must refer back to the purchase of the vehicle and must be intended to support other visitors of mobile.de with the decision-making. Specifically prohibited is the inclusion of advertising.
b) Ratings need to be drawn up in a constructive way; the rater must remain fair. Insults, threatening, political, ethnical or discriminatory opinions, false factual claims as well as defamatory content are prohibited.
c) Also not permitted is any other content that violates the law or the rights of third parties. Violation of rights of third parties may apply e.g. where content from third party ratings (also from other platforms) are copied onto mobile.de.
Replies to the Rater

b) The replies need to be drawn up in a constructive manner, the dealer must remain fair. Insults, threatening, political, ethnical or discriminatory opinions, false factual claims as well as defamatory contents are prohibited.
c) Also not permitted is any other content that violates the law or the rights of third parties. Violation of rights of third parties may apply e.g. where content from third party ratings (also from other platforms) are copied onto mobile.de.

Report Ratings!
How to report contents on mobile.de
In the event that a rating or a reply violates the rules for ratings, you have the right to notify mobile.de. We will then review the content with the means available to us and will implement further measures where necessary. The deletion of a rating or a reply will be effected where these violate the rules for ratings or the rules for replies by the dealers, as applicable. Where such violation affects only part of a rating text or a reply of a dealer, only the respective affected part shall be deleted and marked accordingly (in this case, the awarded score and the rest of the text of the rating or the reply of the dealer shall remain).
In case of a request for information from law enforcement or supervisory authorities in connection with preliminary proceedings, the suspicion of an offence or a unlawful act, the requested data will be (if available) provided to the corresponded authority.
