mobile.de provides you with your own Dealer Homepage where you can advertise your own vehicles. There are specific legal requirements you must adhere to regarding the display of what is known as Imprint information (Impressum). By complying with these rules, you will avoid any fines from third parties.
When you register on mobile.de, you automatically receive a complimentary Dealer Homepage. This page automatically displays your vehicles, services and the data you entered when registering on mobile.de. You are required by law to correctly complete the Imprint information for this Dealer Homepage. If this data does not meet legal requirements, you are at risk of incurring fines.
Pursuant to § 5 of the Telemedia Act (Telemediengesetz TMG), any seller that uses commercial electronic media must supply certain information (what is known in German as "Impressumspflicht", or obligation to provide "Imprint" information). Whether § 5 also applies to individual ads or offers on mobile.de is legally debatable, and the highest court of law has yet to decide on this issue. When in doubt, please consult with your attorney or other legal counsel.
Information under the Telemedia Act
According § 5 TMG, the Imprint must include the following information:
- The provider's name and the address where a summons can be served, also the authorised representatives for legal entities
- Information that enable swift electronic contact and immediate communication (e.g. phone, fax) with the provider, including the email address
- The commercial register, associations register, partnerships register or cooperative societies register in which the provider is registered, and the corresponding registry number
- VAT ID number, if available, in compliance with Article 27a of the VAT Act
- Commercial ID number ("Wirtschafts-Identifikationsnummer"), if available, in compliance with Article 139c of the German Fiscal Code
